2. Acceptance of Terms
By accessing or using the Site, creating an account, or placing an order, you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be bound by them. If you do not agree to these Terms, you must not use the Site.
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site following the posting of revised Terms constitutes your acceptance of those changes. We will indicate the effective date of the most current version at the top of this page.
3. Products and Descriptions
Maple Brothers Co. makes every effort to ensure that product descriptions, images, and information on the Site are accurate and complete. However, we do not warrant that product descriptions or other content on the Site are accurate, complete, reliable, current, or error-free.
All product images are for illustrative purposes only. Actual products may vary slightly from images shown. We reserve the right to limit the quantities of any products or services that we offer, and to discontinue any product at any time.
In the event that a product is listed at an incorrect price due to a typographical error or error in pricing information, we reserve the right to refuse or cancel any orders placed for that product at the incorrect price, whether or not the order has been confirmed and your payment processed.
4. Ordering and Payment
When you place an order through the Site, you are making an offer to purchase the product(s) at the listed price. We reserve the right to accept or decline your order for any reason, including but not limited to product availability, errors in product or pricing information, or concerns about fraud.
Upon placing an order, you will receive an order confirmation email. This confirmation email is an acknowledgment that we have received your order and does not constitute acceptance of your order. Acceptance of your order occurs when we dispatch the product and send you a shipping confirmation email.
We accept payment via major credit cards and other payment methods made available through our checkout. All payments are processed securely through our payment processor. By providing your payment information, you authorize us to charge the applicable amount for your order.
All prices on the Site are listed in US Dollars (USD) and are inclusive of any applicable product costs but exclusive of shipping, taxes, and duties, which will be calculated and displayed at checkout.
5. Sales Tax
Maple Brothers Co. collects sales tax in jurisdictions where we are required to do so by law. The applicable sales tax will be calculated and displayed at checkout based on your shipping address. You are responsible for any additional taxes, duties, or import fees applicable to international orders.
6. Shipping and Delivery
Shipping terms, estimated delivery timelines, and our free shipping threshold are governed by our Shipping Policy, which is incorporated into these Terms by reference and available at www.themaplebrothers.com/policies/shipping-policy.
We are not responsible for delays caused by shipping carriers, customs processing, weather events, or other circumstances beyond our reasonable control. Title and risk of loss for all products pass to you upon delivery to the shipping carrier.
7. Refunds and Returns
Due to the perishable and food-safety nature of our products, Maple Brothers Co. does not accept returns of opened or used products. Our complete Refund and Returns Policy, which governs all refund eligibility and procedures, is incorporated into these Terms by reference and available at www.themaplebrothers.com/policies/refund-policy.
Nothing in these Terms limits your rights under applicable consumer protection laws, including statutory rights that cannot be waived by contract.
8. Intellectual Property
All content on the Site — including but not limited to text, graphics, logos, images, product descriptions, audio clips, digital downloads, and software — is the property of Maple Brothers Co. or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site without our prior written consent, except as follows:

If you submit, post, or transmit any content to the Site — including reviews, photos, comments, or any other material ("User Content") — you grant Maple Brothers Co. a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content throughout the world in any media.
You represent and warrant that: (a) you own or control all rights to the User Content; (b) the User Content is accurate and not misleading; (c) use of the User Content does not violate these Terms and will not cause injury to any person or entity.
We reserve the right, but are not obligated, to monitor, edit, or remove any User Content that we determine in our sole discretion is unlawful, offensive, threatening, defamatory, obscene, or otherwise objectionable.
10. Privacy
Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference and available at www.themaplebrothers.com/policies/privacy-policy. By using the Site, you consent to our collection and use of your personal information as described in the Privacy Policy.

We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. 12. Disclaimer of Warranties
THE SITE AND ALL PRODUCTS AND SERVICES OFFERED THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, MAPLE BROTHERS CO. DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Maple Brothers Co. does not warrant that: (a) the Site will be uninterrupted or error-free; (b) defects will be corrected; (c) the Site or the servers that make it available are free of viruses or harmful components; or (d) the results of using the Site will meet your requirements.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MAPLE BROTHERS CO., ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SITE OR PRODUCTS.
IN NO EVENT SHALL MAPLE BROTHERS CO.'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU FOR PRODUCTS PURCHASED THROUGH THE SITE IN THE SIX (6) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED US DOLLARS ($100.00).
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you.
14. Indemnification
You agree to defend, indemnify, and hold harmless Maple Brothers Co. and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your violation of these Terms; (b) any User Content you submit; (c) your use of the Site; or (d) your violation of any third-party rights.
15. Food Safety and Allergen Notice
Our products are manufactured in a facility that may process tree nuts, wheat, gluten, dairy, soy, and other common allergens. While we take precautions to avoid cross-contamination, we cannot guarantee that any product is completely free from traces of allergens. Allergen information for each product is available on the product page and on the product packaging.
If you have a severe food allergy or sensitivity, please review all allergen information carefully before purchasing. By purchasing our products, you acknowledge that you have reviewed and understood the allergen information applicable to your order.
16. Governing Law and Jurisdiction
These Terms and any dispute arising out of or related to them or the Site shall be governed by and construed in accordance with the laws of the State of Delaware, without giving effect to any choice or conflict of law provisions. Subject to the arbitration agreement in Section 17, you consent to the exclusive jurisdiction of the state and federal courts located in the State of Vermont for any claims not subject to arbitration.
17. Binding Arbitration and Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT OR TO PARTICIPATE IN A CLASS ACTION.
Vermont Acknowledgment of Arbitration (required by 12 V.S.A. § 5652(b)): By accepting these Terms, you acknowledge that your agreement with Maple Brothers Co. contains an agreement to arbitrate. After accepting these Terms, you understand that you will not be able to bring a lawsuit concerning any dispute that may arise which is covered by the arbitration agreement, unless it involves a question of constitutional or civil rights. Instead, you agree to submit any such dispute to an impartial arbitrator.
Agreement to Arbitrate. You and Maple Brothers Co. agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site or purchase of products (collectively, "Dispute") shall be resolved by binding arbitration, rather than in court, except that either party may bring claims in small claims court if the claim qualifies. This arbitration agreement is governed by the Federal Arbitration Act (9 U.S.C. §§ 1 et seq.).
Arbitration Rules. The arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules (not Commercial Rules), which are available at www.adr.org. A single arbitrator shall hear the dispute. The arbitration will be conducted in English. The location of the arbitration shall be the State of Vermont, or by telephone or video conference at either party’s election. In no event shall you be required to travel to a location outside Vermont to participate in arbitration proceedings.
Arbitration Costs and Fees. Maple Brothers Co. will pay all AAA filing fees, administrative fees, and arbitrator fees for any arbitration that you initiate, up to $5,000 in total arbitration costs. If the arbitrator determines that your claim was frivolous or brought in bad faith, you may be required to reimburse Maple Brothers Co. for fees paid on your behalf. Each party shall bear its own attorney’s fees, except that the arbitrator may award attorney’s fees to the prevailing party where permitted by applicable law. In no event shall your total out-of-pocket costs for arbitration exceed what they would be in a comparable court proceeding in the State of Vermont.
Class Action Waiver. You and Maple Brothers Co. agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a class or representative proceeding. If this class action waiver is found to be unenforceable in any specific case, then the entirety of this arbitration agreement shall be null and void with respect to that case, and the dispute shall be resolved in a court of competent jurisdiction in the State of Vermont.
Constitutional and Civil Rights. Nothing in this arbitration agreement prevents you from seeking or obtaining the assistance of courts in enforcing your constitutional or civil rights, as provided under 12 V.S.A. § 5653(b).
Opt-Out Right. You may opt out of this arbitration agreement by sending written notice to Maple Brothers Co. at 105 Depot Street, Unit 118, Stowe, VT 05672, or by email to hello@themaplebrothers.com, within thirty (30) days of first accepting these Terms. Your notice must include your name, mailing address, and a clear statement that you wish to opt out of arbitration. If you opt out, the class action waiver above shall also not apply to you.
Exceptions. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief from a court of competent jurisdiction in the State of Vermont to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights, or to prevent imminent harm that cannot be adequately remedied through arbitration.
Severability. If any part of this arbitration agreement (other than the class action waiver) is found to be unenforceable, the remaining parts shall continue in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy, Refund Policy, and Shipping Policy, constitute the entire agreement between you and Maple Brothers Co. regarding the Site and your purchases, and supersede all prior agreements, understandings, and representations.
19. Severability
If any provision of these Terms is held to be unlawful, void, or unenforceable, that provision shall be deemed severable from the remaining provisions and shall not affect their validity and enforceability.
20. Waiver
No waiver by Maple Brothers Co. of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition, and any failure by Maple Brothers Co. to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
